The plaintiff Clyde Harper recovered a judgment against Allen Norton, Jr. for personal injuries suffered in the amount of $7,636.50 while he was a passenger in a 1951 Cadillac driven by Norton. This suit was brought on the judgment against the defendant Hartford Accident and Indemnity Company who insured the Lincoln Manufacturing Company, the owner of the car. The complaint alleged Norton on September 27, 1954, the date of the accident, had obtained permission to drive the Cadillac and was covered by the defendant's policy, which was denied by the answer. The defendant moved for a summary judgment, which motion was granted. Judgment was entered dismissing the complaint, and the plaintiff appealed. HALLOWS, Justice.
